1. General terms

By placing an order you accept our Terms and Conditions.

Pearl Music Europe B.V. (hereafter Pearlwebshop.com) reserves the right to change its Terms and Conditions without prior notice.

2. Cancellation of your order

Every order can be cancelled, without payment of a fine and without giving any reasons, if not yet shipped within 24 hours after the order is placed. Therefore you have to make a ticket in your account. Your cancellation will be confirmed by e-mail. Once your request for cancellation has been confirmed by us, you may consider it approved.

If you have already paid the order you are cancelling, Pearlwebshop.com reimburses the amount paid at the latest within fourteen (14) days. If the order is cancelled later an amount of € 2.50 will be charged.

3. Delivery

Delivery will only take place within Europe.

Delivery will take place as long as supplies last. Pearlwebshop.com aims at sending orders within 48 hours after receipt of your payment, however, Pearlwebshop.com cannot be held responsible for sending your order out late. We send via TNT Parcel Service.

The final delivery time for items will be 30 days after placement of orders. If it is not possible to supply the customer within 30 days the customer will be informed in time and he has the right to cancel the order free of charge.

4. Prices

The articles have to be paid in Euros, including VAT. Shipping costs (unless mentioned otherwise) are not included in these prices. Before contracting the agreement, the total price including shipping will be displayed on our website. All prices quoted on our web shop are with errors and omissions excepted.

5. Shipping

For the packaging and shipping a contribution is included according to the following scheme. All shipping prices quoted on our web shop are with errors and omissions excepted.

All our supplies are sent by TNT parcel service.

The shipping costs will be shown before you finally confirm your order.

Europe under 500 gram        € 14.95

Europe over 500 gram          € 21.95

6. Payment

Payment of your order can be done by one of the following ways:

iDeal

iDEAL is a simple, fast and secure internet payment method based upon internet banking. When paying with iDEAL, you are directed via a secure connection to your internet bank account at your financial institution. After logging in, you confirm the payment with the security method of your bank. This method can only be used when you have a Dutch bank account;

PayPal

After placing your order you will be automatically be redirected to the PayPal page where you can transfer the amount. Within PayPal payment by credit card are also available.

Credit Card

Credit Card payments can be made via PayPal (see PayPal).

7. Term of approval

Unless indicated otherwise, after Pearlwebshop.com receives your order, you have the right to cancel the purchase within 7 days by issuing a ticket via the ticket system without giving any reasons and to return the order within the same deadline. Any payments (excluding administration and postage) will be returned within 14 days. There is no right of  reimbursement if the product is used and / or damaged or if the order has been opened and / or is not returned in the original packaging. After the expiration of the term of approval of 7 days the purchase is deemed to be confirmed and cannot be cancelled.

8. Ownership transfer

The ownership of products transfers only when the customer has paid in full.

9. Responsibility whilst shipping

We are not responsible for loss or damage of goods during shipment. If an unexpected problem will arise, we will be pleased to hear of it so we can lodge a complaint with TNT parcel service.

10. Data

When you order an item at Pearlwebshop.com, your information will be included in the customer database of Pearlwebshop.com. Pearlwebshop.com adheres to the Law Personal Registration and will not share your information with third parties. See our Privacy Policy. Pearlwebshop.com respects the privacy of users of the Internet site and will ensure the confidentiality of your personal data. Pearlwebshop.com uses a mailing list; each mailing contains instructions how to unsubscribe yourself from this list. When you order an item at Pearlwebshop.com, you are automatically signed up for this mailing list.

11. Guarantee

Pearlwebshop.com ensures that its products meet the requirements of usability, reliability and longevity as reasonably designed by parties to the sale and is thus responsible for the guarantee of the product delivered to you.

12. Agreement

Pearlwebshop.com reserves the right to refuse orders without reason and we do not accept contractual agreements.

13. Images and specifications

All graphics, photographs, drawings, information on weights, dimensions, colours, images of labels etc. at the site of Pearlwebshop.com are shown for indicative purposes only and may not lead to damages or dissolution of the contract. It is not allowed to copy images and / or text from the site of Pearlwebshop.com without our consent.

14. Returns and defects

Despite the great care that we devote to your order, it can happen that an article has a failure or you can receive the wrong product. In these cases you should contact Pearlwebshop.com within 7 days, by using the online ticket system on our website. Unstamped shipments are not accepted. For a quick handling of your complaint you should return a copy of the delivery form and the reason of returning.

The return address can be found on the order confirmation and at the website under Shipping & Returns.

15. Complaints

If you have a complaint about your purchase, please contact Pearlwebshop.com within 7 days, by making a ticket in your account. The costs for returning an article with a complaint will be first on behalf of the customer. These costs will be credited if the complaint is well founded. We urge you to contact us first and not to repair the articles yourself or to have it repaired by a third party. If you repair the article yourself or have it repaired by a third party without our prior agreement, we cannot take your complaint into consideration.

16. Force majeure

Pearlwebshop.com has the right, in case of force majeure, to suspend or to resolve a customer's order or contract without judicial intervention, notifying the client by letter. Pearlwebshop.com does not accept any responsibility for any damages, unless it appears unacceptable under the circumstances to standards of reasonableness and fairness.

17. Applicable law and jurisdiction

All rights, obligations, offers, contracts and agreements to which these Terms and Conditions apply, are exclusively governed by Dutch law.

The Court of Roermond in the Netherlands is the sole court entitled to mediate in disputes between the parties.

18. Any questions, complaints and comments

If, after reading these Conditions, you may have any complaints, questions or comments about these terms, please do not hesitate in writing, to contact us via the ticket system of your account.
